Gokhale Method Enterprise, Inc. and its subsidiary Gokhale Method Institute, Inc. (collectively “Gokhale Method”, "we", "us", and/or "our") operate multiple websites (each a “Site”, collectively the “Sites”), including www.gokhalemethod.com. The Sites are operated by Gokhale Method and have been created to provide information about our company and its content and data linking platform and related services (together with the Sites, the "Service(s)") to our Service visitors ("you", "your"). This Privacy Policy informs you of our policies regarding the collection, use, and disclosure of information including personal data and other information that is collected from visitors to the Sites and Services.

We use your data to provide and improve the Service. By using the Service, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms of Service, accessible from https://www.gokhalemethod.com/TOS.

Definitions

We want to keep the legal text readable.

Therefore we define what we mean with the terms used throughout this privacy policy.

The User is the individual using our Service. The User corresponds to the Data Subject, who is the subject of Personal Data.

Information We Collect

We ask for certain information like your name, email address, address, and account credentials to use Gokhale Method. We use this information to run Gokhale Method and other things mentioned in this privacy policy (like logging and analytics).

For your convenience, we use cookies so you don't have to log in every time you visit our website.

We will delete your data when we no longer need it (e.g. when you delete your account and there are no other legal obligations to keep your data)

Personal Data That You Provide Through the Services:

We collect Personal Data from you when you voluntarily provide such information, such as when you contact us with inquiries, respond to one of our surveys, register for access to the Gokhale Method Services or use certain Gokhale Method Services. Wherever Gokhale Method collects Personal Data we make an effort to provide a link to this Privacy Policy. You can choose at any time to opt out by contacting support at [email protected]; you can also contact us to opt out of your information being used for purposes other than it was originally collected.

By voluntarily providing us with Personal Data, you are consenting to our use of it in accordance with this Privacy Policy. If you provide Personal Data to the Services, you acknowledge and agree that such Personal Data may be transferred from your current location to the offices and servers of Gokhale Method and the authorized third parties referred to herein located in the United States. The Personal Information that you provide can be accessed at any time through your account or you can contact our customer support at [email protected] if you need help accessing your account.

Gokhale Method acknowledges that EU, UK, and Swiss individuals have the right to access the personal information that we maintain about them. An EU, UK, or Swiss individual who seeks access, or who seeks to correct, amend, or delete inaccurate data, should direct their query to [email protected]. If requested to remove data, we will respond within a reasonable timeframe.

Usage Data: We may also collect information how the Service is accessed and used ("Usage Data"). This Usage Data may include information such as your computer's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers, and other diagnostic data.

Cookies: In operating the Services, we may use a technology called "cookies." A cookie is a piece of information that the computer that hosts our Services gives to your browser when you access the Services. Our cookies help provide additional functionality to the Services and help us analyze Services usage more accurately. For instance, our Services may set a cookie on your browser that allows you to access the Services without needing to remember and then enter a password more than once during a visit to the Services. In all cases in which we use cookies, we will not collect Personal Data except with your permission. On most web browsers, you will find a "help" section on the toolbar. Please refer to this section for information on how to receive notification when you are receiving a new cookie and how to turn cookies off. We recommend that you leave cookies turned on because they allow you to take advantage of some of the Services's features.

Aggregated Personal Data: In an ongoing effort to better understand and serve the users of the Gokhale Method Services, we often conduct research on our customer demographics, interests and behavior based on the Personal Data and other information provided to us. This research may be compiled and analyzed on an aggregate basis, and Gokhale Method may share this aggregate data with its affiliates, agents and business partners. This aggregate information does not identify you personally. Gokhale Method may also disclose aggregated user statistics in order to describe our services to current and prospective business partners, and to other third parties for other lawful purposes.

Gokhale Method will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

We will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer time periods.

Our Use of Your Personal Data and Other Information

Gokhale Method won't sell or rent your personal information to a third party. Primarily, we use personal data to run Gokhale Method. We may use personal data to provide you with predictions about other services you might be interested in on Gokhale Method. If we intend to use your personal data in a way we have not mentioned, we will let you know when we collect that information.

Sometimes we aggregate user data anonymously to understand our customer base better.

 

Gokhale Method will not sell or rent to any third party any of the Personal Information or Personal Data that you provide to us.

Gokhale Method uses the Personal Data you provide in a manner that is consistent with this Privacy Policy. If you provide Personal Data for a certain reason, we may use the Personal Data in connection with the reason for which it was provided. For instance, if you contact us by email, we will use the Personal Data you provide to answer your question or resolve your problem. Also, if you provide Personal Data in order to obtain access to the Gokhale Method Services, we will use your Personal Data to provide you with access to such services and to monitor your use of such services.

Gokhale Method and its subsidiaries and affiliates (the "Gokhale Method Related Companies") may also use your Personal Data and other personally non-identifiable information collected through the Services to help us maintain and improve the content and functionality of the Services, to better understand our users, and to improve the Gokhale Method Services.

Gokhale Method and its affiliates may use this information to contact you in the future to tell you about services we believe will be of interest to you. If we do so, each communication we send you will contain instructions permitting you to "opt-out" of receiving future communications. In addition, if at any time you wish not to receive any future communications or you wish to have your name deleted from our mailing lists, please contact us as indicated below.

We will provide an individual opt-out or opt-in choice before we share your data with third parties other than our agents, or before we use it for a purpose other than which it was originally collected or subsequently authorized.

If Gokhale Method intends on using any Personal Data in any manner that is not consistent with this Privacy Policy, you will be informed of such anticipated use prior to or at the time at which the Personal Data is collected.

Our Disclosure of Your Personal Data and Other Information

We don't sell your personal data. If we work with partners or contractors, they may have limited access to your personal data but only so much to do their job.

If we sell the company, personal data may be included in the transfer.

 

You can visit the Services without providing any Personal Data. If you choose not to provide any Personal Data, you may not be able to use certain Gokhale Method Services.

Gokhale Method is not in the business of selling your information. We consider this information to be a vital part of our relationship with you. There are, however, certain circumstances in which we may share your Personal Data with certain third parties without further notice to you, as set forth below:

Business Transfers: As we develop our business, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, dissolution, or similar event, Personal Data may be part of the transferred assets.

Related Companies: We may also share your Personal Data with our Related Companies for purposes consistent with this Privacy Policy.

Agents, Consultants and Related Third Parties: Gokhale Method, like many businesses, sometimes hires other companies to perform certain business-related functions. Examples of such functions include mailing information, maintaining databases, and processing payments. When we employ another company to perform a function of this nature, we only provide them with the information that they need to perform their specific function.

Legal Requirements: Gokhale Method may disclose your Personal Data if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, (ii) protect and defend the rights or property of Gokhale Method, (iii) act in urgent circumstances to protect the personal safety of users of the Services or the public, or (iv) protect against legal liability.
We may be required to disclose an individual’s personal information in response to a lawful request by public authorities, including to meet national security or law enforcement requirements.

In cases of onward transfer to third parties of data of EU, UK, or Swiss individuals received pursuant to the EU-US, Swiss-US, and the UK Extension to the EU-US DPF, Gokhale Method is potentially liable.

Third-Party Payment Processor

We use different third-party payment processors like Authorize.net, Stripe, Shopify Payments, or PayPal Express Checkout for all payments. Gokhale Method does not store credit card details and instead relies on these third-party payment processors for this.

 

We use third-party payment processors to process payments made to us. In connection with the processing of such payments, we do not retain any personally identifiable information or any financial information such as credit card numbers. Rather, all such information is provided directly to one of our third-party processors whose use of your Personal Information is governed by their privacy policies. Service Providers

We use Google Analytics and HotJar in order to analyze user behavior and improve our webpage.

We use social media plugins (e.g. the Facebook “Share” button) on our webpage.

We also use Shopify to power our online store.

We use Planyo to manage parts of our reservation system.

 

We may use third-party Service Providers to monitor and analyze the use of our Service.

Google Analytics

Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network.

You can opt out of having made your activity on the Service available to Google Analytics by installing the Google Analytics opt-out browser add-on. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js, and dc.js) from sharing information with Google Analytics about visits activity.

HotJar

HotJar is a web analytics service that tracks and reports website traffic. We use HotJar to understand how users behave on our site.

Social Media plugins

On certain webpages of our website we may implement so-called social media plugins. When you visit a page that displays one or more of such buttons your browser will establish a direct connection to the respective server and load the button from there. At the same time the button provider will know that the respective page on our website has been visited. This processing is based on Article 6 sec. 1 sent. 1 lit. f GDPR and represents our legitimate interest to improve your website experience and to optimize our services.

We have no influence on the data that the button provider collects on the basis of the button. According to the available information, however, if you do not click on the respective buttons no personal data will be collected and stored unless you have logged onto to your respective account with that provider. In that case certain user data (including your IP address at the time) may be collected and linked to the account information already present at the respective provider. If you wish to prevent this, please log out of your social media accounts before visiting our website.

In addition, clicking a button may also lead to a collection of certain data, such as the user’s IP address. The button provider may set cookies as well, unless you have disabled the acceptance and storage of cookies in your browser settings.

We receive no information from the button providers about which social media buttons you may have clicked or seen on our website, but, if at all, we may receive a summarized, non-person-related statistical report on the use of the buttons.

We encourage you to review the privacy notices of those third parties to learn about their Personal Data and privacy practices.

Shopify

“Do Not Track” Signals

We don’t track you, so we do not respond to Do Not Track (DNT) signals (also there doesn’t yet exist a standard across browsers on how to react to these signals).

 

We do not track you over time and across third party websites to provide targeted advertising. However, some third party sites do keep track of your browsing activities when they serve you content, which enables them to tailor what they present to you.

Some browsers have incorporated "Do Not Track" (DNT) features that can send a signal to the websites you visit indicating you do not wish to be tracked. Because there is not yet a common understanding of how to interpret the DNT signal, our Services do not currently respond to browser DNT signals.

You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser.

Exclusions

This privacy policy only applies to private information we collect. If you post information in a public place, like our support forums, this is public information and can be shared and reproduced.

Similarly, if you join a Gokhale Method event, certain of your personal information may be available to your teacher (= the event host) and other event participants.

If you use one of our posture tracking devices (e.g. SpineTracker™, PostureTracker™), your former, present, and future teachers will be able to see this data.

 

This Privacy Policy does not apply to any Personal Data collected by Gokhale Method other than Personal Data collected through the Services. This Privacy Policy shall not apply to any unsolicited information you provide to Gokhale Method through the Services or through any other means. This includes, but is not limited to, information posted to any public areas of the Services, such as forums or watercoolers (collectively, "Public Areas"), or other unsolicited submissions (collectively, "Unsolicited Information"). All Unsolicited Information shall be deemed to be non-confidential and Gokhale Method shall be free to reproduce, use, disclose, and distribute such Unsolicited Information to others without limitation or attribution.

If you sign up to a Gokhale Method event, you are agreeing that certain of your information will be shared with the event host and other event participants. In particular, the event host will have access to your name, email address, and intake form, and other team members will have access to your name and email address. Any information you share via an events watercooler will be available to all event participants of the event for which you have signed up. You are solely responsible for any information you share via an event, which is posted at your own risk.

If you additionally opt in to use any of the posture trackers developed by Gokhale Method (e.g. PostureTracker™, SpineTracker™) in one of the events, you are agreeing that information related to this posture tracker can be shared with the event host and any event hosts of past and future events that you sign up for.

Children

You must be 16 years old to use Gokhale Method.

 

Gokhale Method does not knowingly collect Personal Data from children under the age of 16. If you are under the age of 16, please do not submit any Personal Data through the Services. We encourage parents and legal guardians to monitor their children's Internet usage and to help enforce our Privacy Policy by instructing their children never to provide Personal Data on the Services without their permission. If you have reason to believe that a child under the age of 16 has provided Personal Data to Gokhale Method through the Services, please contact us, and we will endeavor to delete that information from our databases.

Links to Other Websites

We link to a lot of third-party websites. Our privacy policy only governs our own website.

 

This Privacy Policy applies only to the Services. The Services may contain links to other websites not operated or controlled by Gokhale Method (the "Third-Party Sites"). The policies and procedures we described here do not apply to the Third-Party Sites. The links from the Services do not imply that Gokhale Method endorses or has reviewed the Third-Party Sites. We strongly advise you to review the Privacy Policy of every site you visit.

Security

We take many steps, including encryption, to ensure your private information and account credentials are safe. To this end, if you find a security problem, contact us and we will fix it immediately. Keep in mind, emails and communications with us are not encrypted.

 

Gokhale Method takes reasonable steps to protect the Personal Data provided via the Services from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, no Internet or email transmission is ever fully secure or error-free and we cannot guarantee its absolute security.

In particular, email sent to or from the Services may not be secure. Therefore, you should take special care in deciding what information you send to us via email. Please keep this in mind when disclosing any Personal Data to Gokhale Method via the Internet.

Rights of EU/EAA Individuals Under EU GDPR

You have the rights to know what data we have about you and to change or delete it.

 

Gokhale Method Enterprise, Inc. aims to take reasonable steps to allow you to correct, amend, delete, or limit the use of your Personal Data.

Whenever made possible, you can update your Personal Data directly within your account settings section. If you are unable to change your Personal Data, please contact us to make the required changes.

If you wish to be informed what Personal Data we hold about you and/or if you want it to be removed from our systems, please contact us.

In certain circumstances, you have the right:

  • To access and receive a copy of the Personal Data we hold about you
  • To rectify any Personal Data held about you that is inaccurate

We are part of the EU-U.S. and Swiss-U.S. DPF, as well as the UK Extension to the EU-U.S. DPF, that allows us to transfer data from European customers to our servers in the US.

Gokhale Method Enterprise and its subsidiaries comply with the EU-U.S. Data Privacy program Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy program Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. Gokhale Method has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework program Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. Gokhale Method has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework program Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles, the UK Extension to the EU-U.S. DPF Principles, and/or the Swiss-U.S. DPF Principles, the Principles shall govern. Gokhale Method is subject to the investigatory and enforcement powers of the Federal Trade Commission (FTC).

In compliance with the EU-US Data Privacy Framework Principles, Gokhale Method commits to resolve complaints about your privacy and our collection or use of your personal information transferred to the United States pursuant to the DPF Principles. The Services and our business may change from time to time. As a result, at times it may be necessary for Gokhale Method to make changes to this Privacy Policy. Gokhale Method reserves the right to update or modify this Privacy Policy at any time and from time to time. If we do this, we will post the changes to this Privacy Policy on this page and will indicate at the top of this page the date these terms were last revised.
